The Recent Supreme Court Decision Reflects A Legal Blunder By The Judges.

PNG should be proud that our West Minister Parliamentary System of Government has come of age and matured and is very vibrant. The recent constitutional crisis has truly demonstrated that.

The Laws and Courts do not exist in a vacuum. In PNG the Judges need to understand and know that the current political, economic, social and cultural environment must be taken into consideration so that justice is not only be done but justice is seen to be done with the wider community perception.

When considering all the factors that led to the recent constitutional crisis, the final analysis is that the Supreme Court Decision went overboard beyond the prescribed constitutional powers reinstating the Grand Chief as PM, we all know that a mistake made by Parliament can only be corrected by the Parliament itself.

That is what exactly has happened and though the Parliament the people have spoken and the majority rules in a democratic society such as ours.

Be careful of what you are implying here as it undermines and jeopardizes the democracy we enjoy as afforded by the Constitution. 70 MPs do not represent the interest and ideals of 7 million souls. The urban minority consisting of interest groups do not represent 7 million. O'Neill, implicated in the NPF saga and his regime part and partial to Somare's, is not GOD-sent. Somare was and is still the legitimate Prime Minister of Papua New Guinea. MPs come and go after 5 years but the Constitution prevails.

  2. 70 MPs represent two thirds of the 7 million souls and they rule. Never a minority government anywhere in the world unless you are a dictator with full backing of the military. That's what Somare tried to do recently but the peoples army thankfully was mature enough to protects it's people. Somare n Co tried a very dangerous move so must hang their head in shame and move on instead of trying to cling to power by whatever means. We respect Somare but he must respect the peoples wishes through the 70 MPs. If Somare still had the people support the cities n town would be up in arms trying to oust O Neil n Namah but look at what is happening. If this farce continues from the Somare Camp they would loose much support from the people. A win win option is to call a truce and compromise and this should be initiated by Somare. Otherwise he n team should take the opposition benches but stop making a mockery of yourself because the PNG you knew is no longer the ignorant n illiterate masses. We deserve better especially from you Grand chief in the eyes of the world.
