*There has been an amendment to the Prime Minister and NEC Act 2002 this morning in parliament, with retrospective effect, that effectively "legalizes" the August 2 removal and election of a new Prime Minister.

CJ is still reading the decision on application by ESPG and has said that there was never a vacancy in the position of PM.


Its now confirmed that Jeffrey Nape's actions were unconstitutional.

Two judges from the 5 men bench have handed own their decision the East Sepik Provincial Court Reference. Chief Justice, Sir Salamoa Injia has rules in favour of Grand Chief Sir Michael Somare whilst Deputy Chief Justice, Gibbs Salika has ruled in favor of current Prime Minister, Peter ONIEL, Justice Bernard Sakora is now deliberating his decision at this moment. Meanwhile, the National and Supreme Court remain on lock down this afternoon as PNG Awaits the Supreme Court deliberation on matters relating to the validity of the election of Peter ONIEL as PM.


To Parliament and the debate on the 2012 continues this afternoon at the Parliament house at this moment, with only one member of the Opposition currently in the chambers. Our Reporter on location, Joy Kisselpar has just advised us that Parliament has agreed to sit beyond 5pm. She has also said that Speaker Jeffery Nape announced that he was stopped by police this afternoon on his way to Parliament and was handed some documents. He says he did not READ the documents but will be handing them over to the Parliamentary Priviledges Committee to read and announce in Parliament later.

The Papua New Guinean government has passed a series of amendments in parliament to legalise the prime minister's elevation to the top job.

Monday's move comes before the Supreme Court hands down its decision on whether Prime Minister Peter O'Neill was constitutionally elected when MPs voted to dump Sir Michael Somare and replace him with Mr O'Neill on August 2.

That decision was due to be handed down at a hearing which began at 1500 AEDT, after being put back from 1000 AEDT.

The laws were passed at 1230 AEDT.

The Prime Minister and National Executive and National Executive Council (Amendment) Act 2011 makes the dumping of Sir Michael legal.

It also specifies that the prime minister can be dismissed if absent from the nation for more than three months.

Sir Michael, before he was dumped on August 2, was absent for five months while he was in Singapore recovering from heart surgery.

The Act passed two readings of PNG's parliament by a vote of 71 to zero, as opposition ministers refused to show up ahead of the court decision.

It is unclear at this stage what the passing of the amendments will mean for the court's decision.
