Sweep team unconstitutional

IS the Task Force Sweep a police force established under the Constitution?
The only established police force by the Constitution is the Royal Papua New Guinea Constabulary (RPNGC).
As a former detective and provincial commander and now a lawyer, I am qualified to make this statement.
In previous cases, the former Mataguan Association established a police force in East New Britain and those associated with the organisation were charged with establishing an illegal police force.
The practice is that no police constable is subjected to any direction from any member of the RPNGC including the police commissioner, in any investigation.
Likewise, the investigating officer who is the arresting officer is not subjected to any direction by anyone, including the police commissioner.
Here we have a civilian lawyer performing the task of a police constable.
He is not sworn in as a member of the RPNGC and does not have the po­wer to arrest or investigate any crime.
The only power of arrest vested in members of the public is a citizen’s arrest; the immediate apprehension of an offender that can only be activated at the time of the commission of an indictable offence.
The 10-judge rules established for the police officers to observe when they are executing their duties ensure that they do not abuse their powers in either breaching the rights of a citizen or arrest any persons without establishing the prima facie case against the accused.    
Here we have a police force personnel being controlled and directed by a civilian and that is clearly in conflict with the RPNGC.
Due to the unconstitutional actions of the present situation, it has sent obvious signs of impartiality in which it would be unsafe to secure any conviction by the court due to the breach.
I will not operate under such a structure that is contrary to the Constitution as well as the practices and principles of the RPNGC and all other police forces in the world.

  1. Passingan has hit the nail on the head but the practice of civilian commandeering uniformed police is not new. A certain media freak comedian at police headquarters has been doing that for ages. And worse that comedian operates from the Commissioner's office. Is it any wonder a lawyer lady of his is also the lawyer for the Commissioner in recent legal fiascos? Can Ombudsman Commission or such similar entities look into these grafts?
