O’NEILL INTERFERING WITH OMBUDSMAN COMMISSION

Whilst the whole country was drawn to the Parakagate, the Ombudsman Commission silently moved in on Peter O’Neill in relation to the UBS loan. Inside sources confirm that O’Neill was given his 21 days right to be heard but sought an extension and was granted 14 days.

His 14 days was over last week and the OC is currently considering referral of PM O’Neill to the Public Prosecutor for prosecution under the leadership code before a leadership tribunal. Mr O’Neill through Isaac Lupari (the Master Strategist) tried to undermine the OC Investigations by using one junior legal officer
at OC by the name Howard Maliso who is also from Mr Lupari’s place.Maliso wanted to destroy the file but the OC officials caught wind of his intentions and quickly hid the files.Now it is imminent that OC would be referring PM O’Neill in the coming days. To avoid all of these, Prime Minister O’Neill quickly caused a meeting and appointed

Howard Maliso as one of the Ombudsman to take the place of late Ombudsman John Nero (accountant by profession). His appointment was gazetted last Friday and is Gazette No. G 297 of 2014. Individual Ombudsman have the power of veto so if Maliso goes in as agent of PM O’Neill, it would seriously affect the case that is about to be referred to Public Prosecutor.

A fundamental flaw in the appointment did not become a concern to Mr O’Neill in his haste to take control of things and be in power.  The Organic Law on Ombudsman Commission provides four QUALIFICATIONS FOR APPOINTMENT.

(1) A person is not eligible for appointment as the Chief Ombudsman unless he is, in the opinion of the Committee, a person of integrity,
independence of mind, resolution and high standing in the community.

(2) One of the Ombudsmen shall have such professional accountancy qualifications and experience as, in the opinion of the Committee, is appropriate. Despite the fact that Maliso does not qualify under that mandatory provision of the Organic Law,

Peter O’Neill still went ahead and appointed him. It is understood there are many other cases involving Peter O’Neill that the OC is considering and would be referred for prosecution.
