Dubam's claims laughable


Bryan Kramer who was recently charged by Police on allegations of conspiracy to murder the Minister of Petroleum Nixon Duban and two other persons describes the charges against him as ‘laughable’.
 

Mr Kramer was arrested last week and locked up in the Boroko cell before he was released on bail.
In a media release send to Post-Courier, He said the allegations were clearly invented by Mr Duban in a desperate effort to silence him from informing the public of high-profile corruption in the Government and divert attention from Duban's own criminal prosecution in relation to bribery and fraud charges committed during 2012 General Elections. 


“My conscience is clear and so is my record. I'm not surprised or phased by Duban's allegations or the police charge against me,” Mr Kramer told Post-Courier.
He said his lawyer has advised him against commenting on the case as the matter is before the Courts, however he would comment on the events that led to his arrest.


Kramer said he was first made aware of the allegations in July 2014 when investigating officers from Port Moresby travelled to Madang and served a search warrant on his residence. The officers could not execute it because Mr Kramer was in Port Moresby prosecuting his second election petition against Duban on further bribery and fraud allegations committed during 2013 Madang Open By-Election. 


The by-election was ordered by the Court of Election Disputed Returns in June 2013 after finding Duban guilty of committing bribery and undue influence during 2012 General Elections.
He said after he was being informed of the search warrant he formally wrote to the Madang Provincial Police Commander (PPC) Sylvester Kalaut explaining that he was out of Madang but happy to make himself available to be interviewed. 


He wrote that should the police believe there were reasonable grounds to charge him then he respected their constitutional duty to do so and would defend the charges in the Courts.
When Mr Kramer returned back to Madang he reported to the Officer in Charge of Crime Investigation Division (CID). The officer explained to him that Madang Police did not have carriage of the case, and that Duban had initially attempted to file a complaint in July some six months after the date of the alleged offence. The officer said that due to the lapse of time, the political nature and sensational allegations, they declined to investigate. The officer said that a week later a team of officers from Port Moresby arrived in Madang claiming the complaint was filed at 6 Mile Police Station in Port Moresby. 


“When I asked the Officer in charge of CID who I should report to, to be interviewed, he said he was unsure as he had no dealings with the officers from Port Moresby, and suggested I contact National Capital District police.
“I returned to Port Moresby the following week and made an appointment to meet with Metropolitan Superintendent, Andy Bawa. I explained the background of the case and that I was wished to make myself available for interview. He stated he was not aware of any officers from Port Moresby deployed to Madang to carry-out any such investigation,” Kramer said.


He said it became clear to him that the charges were invented by Duban to interfere with the prosecution of his (Kramer’s) election petition against him, because after his (Kramer’s) petition was dismissed the allegations were no longer pursued.


Kramer said that about four months after the issue first surfaced, and around the time the Prime Minister took issue with him breaking the story of the his referral to the Leadership Tribunal, he was tracked down like a criminal by a handful officers as if he had been evading arrest, interviewed, charged and locked up without bail.


On the day of his arrest, Metropolitan Superintendent Bawa, as well as Acting NCD/Central Divisional Commander Jerry Frank, are on record that they knew nothing of his arrest, Kramer said.
“When my lawyer made request to the Metropolitan Superintendent for bail, he (Met Supt) was advised that the Investigating office issued a directive that my bail be refused. I was forced to apply for bail from the District Court late Wednesday evening. Even after obtaining an order from the District Court at 12pm at night the officer in charge of Boroko Police Station refused to release me. My lawyer threatened to file contempt proceedings against him before he complied.”


“The irony about this whole issue was I that I was charged, put in jail and refused bail by the very Government who swore an oath to protect its citizens and while in jail it was the people in the cell with me that looked after me. Like me they never resisted nor did they abuse their high office or expend millions in public money on overseas lawyers to avoid arrest. Innocent people look forward to clearing their name in the Court of Law, and those who are guilty will do everything under the sun to avoid their arrest in fear of being convicted and sentenced to prison,” Mr Kramer said.
