This occurs when there is need for particular expertise or the Attorney General is unable to undertake the work itself. From Finance Department records a Commission of enquiry found that over the period 2000 to 2006 the State incurred liability in payouts of approximately K100 million in legal fees. The Inquiry saw that there has been no compliance with the Public Finances (Management) Act procedures of expenditure for approval prior to engaging in those brief outs. Six years ago things begin to change, taking a toll to all new level with corruption wide spreading in every government offices. When the country was about to embrace the benefits of the largest LNG project in the Pacific, a forcefully taken government was formed with Peter O’Neill at the rudder. Literally, Peter O’Neill was forced into the office of the Prime Minister – an issue which the courts find no jurisdiction to intervene. It was a number game and so be it – O’Neill with the numbers took by storm. STATE SOLICITOR’S FUNCTIONS USURPED BY TWIVEY LAWYERS

One of those functions is to clear State contracts for payment etc. The Attorney General can outsource some of the functions of the State Solicitor, such as providing advice on State negotiations etc but not the function of clearing contracts for payment by Finance and Treasury Department.  There is a good reason for it –for check and balances. When the State Solicitor clears the contractual debt, it legitimizes the transaction on behalf of the State hence an entity other than the State Solicitor cannot legitimately replace that function. Sources within the Department of Treasury have advised that the controversial law firm –Twivey Lawyers – had been contracted by the sleazy Attorney General to usurp the powers of the State Solicitor and perform the non-delegable function of clearing contracts before Department of Treasury could pay. CALCULATING DAILY COSTS OF PROTECTING PETER O’NEILL FROM ARREST

Prime Ministers do have a security detail. To my knowledge, prior to August 2011, all the Prime Ministers that PNG had had their security detail. At the most, there would be 5 members of the National Security Unit (NSU) of the Police who would provide security to the Prime Minister. At other times (usually), around two or three officers who would be accompanying the Prime Minister. Since the issuance of the arrest warrant against Peter O’Neill, his personal security detail had been boosted to five (5) unmarked Toyota land cruisers on average for the last two years. I am reliably told by one of those persons that this around-the-clock protection to Prime Minister O’Neill is offered, not only by the members of the NSU, but other police officers and PNG Defence members. Since then, we have had seven Prime Ministers in the likes of Sir Michael Somare, Sir Julius Chan, Sir Rabbi Namaliu, Paias Wingti, Late Bill Skate, Sir Mekere Morauta and the controversial incumbent Peter O’Neil. Under the leadership of previous Prime Ministers, country enjoyed tranquility with transition of changeover of leadership (PM) through political manoeuvre but peacefully and done and dusted in the spirit of the constitution. Never had one time experienced a political coup except the incumbent wrestled and forcefully taken over a legitimate government that of Michael Somare. It is telling the tenacity of the aggression to grip on to power by becoming untouchable by laws of the land. POST ANALYSIS ON PM'S LAWYER'S ARREST

by BRYAN KRAMER On Monday 11th April 2016 Members of the National Fraud and Anti-corruption Directorate charged the Prime Minister's Lawyer Ms Tiffany Twivey for one count of allegedly attempting to pervert justice. It is a criminal offence prescribed or defined under Section 136 of the Criminal Code. The provision or section is expressed in the following terms: 136 ATTEMPTING TO PERVERT JUSTICE. A person who attempts, in any way not specially defined in this Code, to obstruct, prevent, pervert or defeat the course of justice is guilty of a misdemeanour. Penalty: Imprisonment for a term not exceeding two years. The key elements to establish a person is guilty of attempting to prevent justice (1) they attempted -put a plan in action (2) with criminal intent (3) to obstruct; pervert or defeat (4) the course or administration of justice. Each and every element must be proven to the criminal standard off prove, being beyond reasonable doubt. In other words after considering the evid
