Twisted tale into corruption [Excessive Legal billings and corrupt state officials]

Image
by MELL LAKA
The Attorney General is empowered to brief private lawyers/counsel to act for the State. This occurs when there is need for particular expertise or the Attorney General is unable to undertake the work itself. From Finance Department records a Commission of enquiry found that over the period 2000 to 2006 the State incurred liability in payouts of approximately K100 million in legal fees. The Inquiry saw that there has been no compliance with the Public Finances (Management) Act procedures of expenditure for approval prior to engaging in those brief outs. A  Commission of enquiry after making extensive examination of these payments with ready assistance from all the law firms concerned except Paul Paraka Lawyers which has been the recipient of at least the K41 million in brief out fees for January 2003 to August 2006 noted in NEC records.

Let me illustrate what I mean by excessive legal fee with our so called Chief Secretary of the National Government, Mr. Isaac Lupari. Mr I…

PNG’s democracy gazes creepy: Laws are bend, broken and institutions are scapegoated with adverse force.

Image
byPETER S. KINJAP

Since independence from 1975, Papua New Guinea has enjoyed a vibrant democracy and the rule of law was at its helm with due respect and law breakers were dealt with accordingly. Six years ago things begin to change, taking a toll to all new level with corruption wide spreading in every government offices. When the country was about to embrace the benefits of the largest LNG project in the Pacific, a forcefully taken government was formed with Peter O’Neill at the rudder. Literally, Peter O’Neill was forced into the office of the Prime Minister – an issue which the courts find no jurisdiction to intervene. It was a number game and so be it – O’Neill with the numbers took by storm.

This ‘invasion’ mounted a psychological effect in the minds of Peter O’Neill which was witnessed through his unpreceded and unbecoming behavior of a person to occupy the higher in the country with integrity, moral ethics and sensitivity to the rule of law. The country was shocked with drasti…

BY A WHISKER OF DIVINE INTERVENTION THE MASTER SABOTEUR OF THE CONSTITUTION JUST FELL SHORT

Image
byJOHN ENDEMONGO KUA

The prime minister Peter O'neill and his legal advisors Powes Parkop and Ano Pala , who had so far successfully deluded , many constitutional issues since the unconstitutional formation and conduct of government since the 2nd of August , 2011, when executive government powers was usurped by a rogue and defacto government, undermining the Constitution and the decorum of the rule of law as supreme.

A Supreme Court Reference filed by the East Sepik Provincial Assembly was ruled on by the court as null and void , which yet again was ignored, with yet another unlawful conduct in passing defective legislation which barred the entry of the incumbent prime minister , Sir Michael Somare , refered to as a "stranger" in the house by the member for Bulolo, and ordered removed by the Speaker ( Nape ) in order to seize power.

A second election was conducted illegally to create confusion and by time , with lawyers , for the government and a cheap and contemptous ju…

STATE SOLICITOR’S FUNCTIONS USURPED BY TWIVEY LAWYERS

Image
by TREASURY INSIDER

The State Solicitor performs a key role in the country. One of those functions is to clear State contracts for payment etc. The Attorney General can outsource some of the functions of the State Solicitor, such as providing advice on State negotiations etc but not the function of clearing contracts for payment by Finance and Treasury Department.  There is a good reason for it –for check and balances. When the State Solicitor clears the contractual debt, it legitimizes the transaction on behalf of the State hence an entity other than the State Solicitor cannot legitimately replace that function.
Sources within the Department of Treasury have advised that the controversial law firm –Twivey Lawyers – had been contracted by the sleazy Attorney General to usurp the powers of the State Solicitor and perform the non-delegable function of clearing contracts before Department of Treasury could pay. The request to engage the services of Twivey Lawyers came from none other th…

NORTON ROSS FULL BRIGHT POM OPENING SHOULD BE WELCOMED?

Image
by PHILIP TEE

Should we all join the Minister for Justice, Hon Ano Pala to welcome the establishment of an office in Port Moresby by the global legal firm, Norton Ross Fulbright?. The Minister in charge of Justice matters in the country did so.

The firm which was founded in 1794 has about 58 branches around the world and PNG will now be added to the franchise. The firm’s turnover for 2014 alone was around US$ 1.815 billion.

It is believed the firm’s Sydney Office had been very instrumental in opening the Port Moresby Office. Whilst the firm’s long standing reputation as a global franchise in the legal industry is unmatchable, the firms Sydney Office has a special connection with PNG, especially the Peter O’Neill Government.

There is a Sydney Partner of the firm called Anthony Latimer who has a very special relationship with two known fraudsters, namely Jimmy Maladina and Peter O’Neill. He had been facilitating a number of “legal work” for Jimmy and O’Neill for a number of years. Mr La…

CONSPIRACY OR COINCIDENCE?

Image
NIUGINI OUTLOOK
FIRST, THE ONLY NON-PNC MP OF WESTERN PROVINCE WAS DEPOSED. POLYE IS NOW FIGHTING ELECTORAL FRAUD ALLEGATIONS. NAMAH IS FIGHTING A LEADERSHIP TRIBUNAL. NOW SOMARE'S REPUTATION IS BEING DESTROYED BEFORE THE EYES OF THE NATION.
Meanwhile, Peter O'Neill is off the hook. So is Vagi. So is Pala. In fact, over the past few weeks, one case after another against Peter O'Neill and his cronies have been dismissed in court. Our PM is victorious! He and his cronies now are given the appearance of being squeaky clean, while there seems to be a systematic attempt to depose of each and every one of the PM's principal opponents and get rid of other non-PNC MPs before the election, focusing on what for all outward appearances, appear to be very real corruptions by Somare, Polye, O'Neill, etc etc. Maybe it's all coincidence. Hmm? Why did the Supreme Court so quickly manage to act on the Vote of No Confidence, showing what they are capable of doing, yet the equa…

CALCULATING DAILY COSTS OF PROTECTING PETER O’NEILL FROM ARREST

SECURITY DETAIL

The Security of the Prime Minister of any country should be concern for the citizens of that country and PNG should not be an exception. Prime Ministers do have a security detail. To my knowledge, prior to August 2011, all the Prime Ministers that PNG had had their security detail. At the most, there would be 5 members of the National Security Unit (NSU) of the Police who would provide security to the Prime Minister. At other times (usually), around two or three officers who would be accompanying the Prime Minister.

Since the issuance of the arrest warrant against Peter O’Neill, his personal security detail had been boosted to five (5) unmarked Toyota land cruisers on average for the last two years. I am reliably told by one of those persons that this around-the-clock protection to Prime Minister O’Neill is offered, not only by the members of the NSU, but other police officers and PNG Defence members.

For the last four seeks since the dramatic arr…

PETER O’NEIL AND GARI BAKI COMBINED TO WRITE A NEW CHAPTER IN THE BRIEF POLITICAL HISTORY OF PNG.

Image
byLEKEM LAKI
Papua New Guinea gained independence from the neo-colonial Australian administration in September 16, 1975. Since then, we have had seven Prime Ministers in the likes of Sir Michael Somare, Sir Julius Chan, Sir Rabbi Namaliu, Paias Wingti, Late Bill Skate, Sir Mekere Morauta and the controversial incumbent Peter O’Neil.

Under the leadership of previous Prime Ministers, country enjoyed tranquility with transition of changeover of leadership (PM) through political manoeuvre but peacefully and done and dusted in the spirit of the constitution. Never had one time experienced a political coup except the incumbent wrestled and forcefully taken over a legitimate government that of Michael Somare. It is telling the tenacity of the aggression to grip on to power by becoming untouchable by laws of the land. He has written a new chapter in the brief political history of PNG and is typical of a thief and remember this, a thief comes to steal, destroy and kill.

Never had one time, we …
