A REPLY TO TIFFANY TWIVEY PART 1 OF 3

NOU VADA Tiffany Twivey’s claims that this political impasse has been caused solely by Courts is unbelievably biased and her Article on PNG Attitude Blog is hardly a proper or a proper enough assessment of the political impasse. It is at best a piece of propaganda from a Government consultant being paid a lot of taxpayer’s money. Twivey states: “Repeat, these sorts of orders have NEVER, EVER been made by any Court in a Westminster system of democracy as they are clearly without jurisdiction and are unconstitutional.” First of all let me just say that it is immaterial that such orders have never been given in the Westminster system. It is immaterial because Papua New Guinea is a constitutional democracy and the powers of the Government’s three arms are set out in the Constitution. Twivey’s mention of the Westminster System is at best a spin-doctor tactic… to make her argument broader than it actually is. In fact her argument is narrow and misleading as you will see. Papua New Guinea’s  prime minister, Peter O’Neill, has accused the trade union leader, John Paska, of trying to incite anarchy. Mr Paska is the general secretary of the Trade Union Congress and one of the leaders of a protest in Port Moresby, which has been raising concerns about controversial legislative moves by the government. Mr O’Neill says Mr Paska called for businesses, shops and schools across the city to close. And many have, with no school classes for two days and some businesses and public transport not operating. The prime minister says Mr Paska is conducting a political vendetta against the government, which is threatening peace and good order. He says he wants Mr Paska to account for what he calls his misconduct in office and to desist from making any further calls for civil action and public disturbance. Police dispersed a small crowd of public protesters outside of the Somare Foundation building yesterday, warning of arresting them if they continue.A small gro

Democracy and Constitution being destroyed by Supreme Court.

By Tiffany Twivey-Nonggorr The current constitutional crisis in PNG has been created by certain members of the Supreme Court, not by O’Neill or by Somare. This has happened in three ways: a) Unconstitutional and undemocratic  Orders made by the Supreme Court b) The refusal of Chief Justice to recognise the constitutional powers of the NEC for his removal, placing himself above the law, and c) Refusal by certain Judges to recognise the unlimited constitutional  power of Parliament to legislate – particularly, the Judicial Conduct Act Unconstitutional and Undemocratic Orders made by Supreme Court Certain Judges have exercised powers that according to the Constitution they do not have AND have never been claimed or exercised by any Judge in PNG or anywhere else. These certain members of the Supreme Court gave orders in December 2011 and now again  in April 2012 over Parliament, the type of which have NEVER, EVER been made, not only  in the history of PNG, but in the history of any Westmin
