UNPRECEDENTED LAWLESSNESS BY ONEILL-NAMAH REGIME.


The unprecedented level of lawlessness by the O'Neill-Namah regime is threatening the very fabric of our society and the constituent institutions that go to make up the nation state of Papua New Guinea. This has gone beyond a joke or any semblance of some notion of democratic regime change. What we are witnessing played out before our eyes is the hi-jacking of democracy, the hijacking of the rule of law, the hi-jacking of the social contract that we as a people entered into at Independence to become a nation under one Constitution. That social contract is being abrogated by the O'Neill-Namah regime in the perpetual breach of the Constitution, and their total disregard for the rule of law, and compromising the law enforcement agencies, and abusing the institution of Parliament.

Elsewhere, I have already commented on the devolution and exercise of the peoples power. That the only Constitutionally mandated government was the Somare led NA Coalition government; being the government immediately prior to the 2nd of August changes. The Supreme Court ruled the 2nd of August changes as unconstitutional, thus reinstating Somare as Prime Minister. The Court declared O'Neill/Namah/Nape had acted lawlessly.

That is the law in a democracy such as ours. The Speaker of Parliament was obliged to effect the Supreme Court Orders. He as an Individual is obliged to comply with those orders. Jeffrey Nape ought to give Notice to O'Neill of new sitting arrangements and coordinate the same with Somare to have him reinstated on the floor of Parliament. He did not do that. He proceeded with a Parliament that was not Constitutionally constituted to allow a Prime Minister who was not mandated by the people, as government, the legislative power of the people. That was an act of lawlessness by O'Neill/Namah and Nape.

At NEC a couple of days before the Supreme Court decision, the submission was brought by Namah to impeach and totally discredit and suspend the Chief Justice. This motion was brought as a result of a lot of rumor-mongering among the younger politicians that the Chief Justice had it in for them. In the Cabinet room, Belden Namah announced what he was going to do, but everybody can have their say. Sam Basil (having just returned from a trip on the Falcon with Namah) was the most vocal supported of the motion. Poor Bart Philemon protested but to no avail. The mood was set to derail the Chief Justice. Namah had visits from Duma, Ben Micah, Basil, and had a drunken night at Airways planning this with O'Neill the night before. O'Neill and Namah were drunk till day break at Airways, and Namah was prepped to  go-kill. So it was no surprise that when the sun rose, O'Neill jumped on the Falcon to Hawaii, and Namah was left to go complete the mission.

In any democracy when the Court or the Supreme Court, for that matter, is seized of a matter, you do not go tampering with that process. It does not matter if you are the Prime Minister or the Queen of England. When the Court is seized of a matter it is sacrosanct, and the laws of contempt applies. In this case, what they planned and did execute, to suspend the Chief Justice whilst seized of the Supreme Court Reference dealing with their own legitimacy to govern was in blatant contempt of court. Indeed, the whole of that group of MPs acting as NEC are all in contempt of Court-not just Namah and Marat. That is another act of lawlessness by this regime.

Moving on from that, after the Supreme Court decision, O'Neill/Namah/Nape went to Parliament and decided to pass certain laws to circumvent and nullify the Supreme Court Decision. I note Professor John Luluaki of UPNG Law School has aptly described how unconstitutional and unlawful those laws passed, some to even have retrospective effect. The Parliament was not only unlawfully constituted, but its laws purportedly passed in contempt and defiance of the Supreme Court decision are a nullity. This analysis is correct because Parliament is not above the Constitution. The Constitution is supreme. The Supreme Court is the protector and the voice of the Constitution, and it has spoken. This is yet another level of lawlessness we have witnessed from the O'Neill/Namah/Nape regime.

Hon.Maxtone Graham's recent ill-willed and ill-conceived bid to deport and banish a well known businessman in PNG is another act of lawlessness by this regime. Graham Osborne is someone who helps the kids on the Streets, has contributed so much to the civic life of Port Moresby, and is a friend to all politicians and CEOs and MDs of major companies. He also happens to be a friend of Somare. However, does that entitle Maxtone-Graham to deport the guy without according him due process of the law? Look Jamie may have personal hangups about expats or certain expats, but he must comply with the law. He is an absolute disappointment for someone we had hoped was an intelligent, fair minded, serious leader. he has proven to be small minded and prone to blunders. This is yet another act of lawlessness.

Now to take the cake is Belden Namah, Sam Basil, and John Boito flying over Indonesia with US$250 Million. Now they are threatening the President and Ambassador of Indonesia. So Belden gives them 7 days to respond!!!! Ooooooo I can see the Indonesian President shaking in his boots!! Now how silly and stupid can you all be Mr Sam Basil. Explain yourself Sam Basil. Tell us the story from the beginning. Answer the questions the contributor 'Private' has raised in this blog. These MPs have engaged in money laundering, and if that is proven to be so, then they have engaged in yet another lawless conduct.

The allegations of money laundering by Belden Namah & co are serious Police matter. The Central Bank/Police and Ombudsman must Investigate these MPs and that Falcon Flight. Otherwise, or in addition, there must be a Commission of Inquiry so that all intelligence leads and contacts in Indonesia and Malaysia be investigated to expose the source and purpose of the funds and who else is involved in this shady ring.

These are all acts of lawlessness being visited upon this nation. I conclude by saying that this country does not need this type of leaders. May God give us wisdom in a few months to choose wise leaders for this nation.
