Court maps out path to PNG solution

Papua New Guinea's supreme court has set out a way to deal with the quagmire of cases stemming from the country's ongoing political conflict.

There are a dozen cases clogging the courts stemming from the conflict between Peter O'Neill and Sir Michael Somare over PNG's prime ministership.

Acting chief justice Gibbs Salika says the primary issue is determining who is the legitimate leader.
He said the best way to do it is to deal with two Supreme Court references filed by the O'Neill camp.
They ask for the court's opinions on constitutional questions such as whether the court can interfere with parliament's appointment of a prime minister.

Justice Salika said all other cases have been stayed pending the outcome of the references.
Sir Michael was ousted as prime minister and replaced by Mr O'Neill in August after his seat was declared vacant while he received medical treatment in Singapore.

The supreme court subsequently declared him the rightful leader, plunging the country into turmoil before Mr O'Neill eventually resumed the role after governor-general Michael Ogio backtracked on Sir Michael's appointment.

Mr O'Neill hasremained the effective prime minister with the support of the public service, police, defence force and most MPs despite attempts by Sir Michael, including a botched coup, to return to power.

  1. Supreme Court should ask Marat and Nape if the Supreme Court opinion on their SCRs will be binding on them and other agitators. If not the Supreme Court must reject their bids as being abuse of court process. Grand Chief Somare has won.

  2. Prime Minister Grand Chief Sir Michael Somare hopes O'Neill knows law. Law is very clear. Leader playing politics is Peter O'Neill. Soon truth will set PNG free.
    Many lawyers are questioning O'Neill as to why he did not comply with the Supreme Court decision on 12 December 2011.
    Peter O'Neill is not a lawyer. He is advised to defy the Supreme Court orders. The question is who advised Peter O'Neill?
    Enormous costs were incurred by East Sepik Provincial Government, Parliament and Executive Government and National Alliance Party to seek advisory opinion of the Supreme Court. Yet Peter O'Neill is very very arrogant. He has made Waigani court of Justice an opinion granting court.
    Supreme Court is very very powerless over Peter O'Neill. It has no truth and justice any more. Without leader of justice light of justice has dimmed. Darkness will kill lawful arm of government under O'Neill. We must reject it.

  3. Lawyers for Peter O'Neill know that Supreme Court decision under section 19 of the Constitution is binding on Peter O'Neill. 3 core ruling in SCR No.3 of 2011 are;
    1. Office of Prime Minister was not vacant up to 12 December 2011;
    2. Grand Chief Sir Michael Somare was the Prime Minister;and
    3. Peter O'Neill was unlawfully elected Prime Minister.
    Peter O'Neill is only playing on the ignorance of leaders.
    Now that lawyers are taking up the fight we hope that no lawyer acts for Peter O'Neill.

  7. If somare never went to prison for robbing PNG, oneill will never see the walls of bomana. You critics comment as if oneill is not as powerful as somare. He maybe illegitimate but oneill is the best pm the country has had in the last 7 years. Forget your courts and legal crap opinions, oneill is the pm and a hearty one. GOD bless oneill for being there for us.
