Prime Minister's attack on the Ombudsman Commission should be a cause of concern for PNG

By Joseph Yandapaki The Prime Minister’s unprecedented attack on the independence and integrity of the Ombudsman Commission over his referral for prosecution under the Leadership Code should be of great concern to all Papua New Guineans. The Ombudsman Commission is a critical independent institution of state and is a foundation-stone of good governance of the nation. The Prime Minister’s deceitful attack on it is designed to undermine its standing ahead of any hearing of his case, and ultimately to prevent any prosecution going ahead under a Leadership Tribunal. His actions constitute a direct threat to the effectiveness of the Ombudsman Commission and its role in national affairs. Ultimately they are a direct threat to the commission’s existence. People should not be surprised by the attack, nor by the slyness of it, the use of half-truths and misinformation, and the blatant disregard for the Constitutional processes and procedures that underpin the Ombudsman Commission. BREAKING NEWS: OMBUDSMAN COMMISSION REFERS PETER O'NEILL TO LEADERSHIP TRIBUNAL

The Prime Minister, Peter O’Neill has expressed disappointment in the manner in which the Ombudsman Commission has referred him to the Public Prosecutor. The referral is based on three allegations: 1. Claims that the National Government did not follow administrative and financial processes in acquiring the UBS loan to purchase shares in Oil Search Limited 2. The sacking of Don Polye as Treasurer 3. Making a statement on EMTV relating to the lack of official consultation on the matter. The claims follow the decision by the National Government to raise a UBS bank loan that enabled Papua New Guinea to buy back shares in Oil Search that have since increased in value by close to 500 million Kina. “It is disappointing that the Ombudsman Commission has chosen to take this course of action instead of following procedure and tabling its final investigation in Parliament,” PM O’Neill said. “This is a case of ‘sour grapes’ by former ministers who have been pushing this issue with th

COURT RESTRAINS PRIME MINISTER AND ACTING OMBUDSMAN

Post Analysis - Cause and Effect  By BRYAN KRAMMER  On Wednesday 6th August 2014, the National Court issued interim injunction (temporary prevention) orders restraining (stopping) the Prime Minister (PM) Peter O'Neill as the Chairman of Ombudsman Appointments Committee and his recent appointee Mr. Howard Maliso as Acting Ombudsman. The orders were sought by the Ombudsman Commission (OC) after the PM appointed Maliso as Acting Ombudsman on 4th July 2104. The OC initiated court proceedings to challenge Maliso's appointment on the grounds it was improper and illegal. Both the PM and Maliso are prevented from exercising or implementing any action or decision that may interfere with the work of the OC until the determination of the proceedings. FORMER POLICE COMMISSIONER KULUNGA WITHDRAWS CASE

POST COURIER Former Police Commissioner Sir Tom Kulunga has withdrawn a court case he filed to challenge the NEC decision that terminated him as Police Commissioner. Sir Toami said in a statement yesterday that he had to withdraw the proceedings after careful thought on the continuity of the proceedings. "My reason for instituting the proceedings was not based on personal interest to get back to the office of police commissioner," he said. "I have served my time and reached my retirement age. I had less time left before my contract was up. NATIONAL COURT ORDERS RE-COUNT FOR MADANG OPEN

By BRYAN KRAMMER The National Court in Madang yesterday (6/8/14) ordered a recount of the Madang Open By-Election. The Court upheld Petitioner Peter Yama's election petition disputing the election of Minister of Petroleum and Member for Madang Nixon Duban. Yama disputed the Duban's election on several grounds of errors and omissions (irregularities) by PNG Electoral Commission in conducting the polling and counting of the By-Election. The Trial Judge Sakora sustained the following grounds contested in Yama's petition. 1) Lack of security during polling - the By-Election was conducted without police presence. 2) Two ballot-boxes were destroyed outside the police station. 3) The Returning officer and his Assistant Returning Officer defied written instructions by the Electoral Commissioner Andrew Trawen not to participate in the counting after the preliminary count. 4) Returning Officer refusal to include 6,116 ballot-papers discovered by Yama at his mother'

Three national parliamentarians have been taken to court by the husband of a woman they all allegedly had sex with. Their case went before the Waigani Family Court last Friday and has been adjourned to this Friday for submission. The information in the Court file alleges that the first MP offered the woman K500 and the second MP K800  before having sex with her on separate occasions. The Third MP also allegedly had sex with her but on the understanding that he would marry her and reimburse K100,000.00 to her husband, which the husband paid as bride price. Last week the lawyers representing the the three MPs asked the presiding Magistrate to dismiss the entire proceedings  describing it as frivolous and an abuse of Court Process. The three MPs names have been  leaked by Court Officials and obtained by PNGBlogs and they are; Telefomin MP and 1st term MP, Solan Mirisim Kokopo MP and also a first term MP, Ereman Tobaining and Komo Margarima MP Francis Potape .
