AG PRESS RELEASE AND ANALYSIS


OFFICE OF THE ATTORNEY GENERAL AND MINISTER FOR JUSTICE PRESS STATEMENT

Purpose

1. The purpose of this Press Statement is to clarify the Front Page run by the National Newspaper yesterday 8th July 2014 in which the headline stated "Paraka Paid Legally"

2. The Attorney General, Hon Ano Pala, CMG LLB, MP regrets the headline "Paraka Paid Legally" that was printed in the National Newspaper dated 8th July 2014.

3. The Attorney General further states that the media and in particular the National Newspaper has mis-interpreted and mis-construed his letter to the Commissioner of Police. Furthermore the Attorney General would like to clarify that in relation to the Court Orders as to payments, this is a matter of entirely left for the Court to determine fully in the proceedings which are currently before the courts.

4. In relation to the current Court proceedings (Civil & Criminals) the Attorney General fully understands and respects the due process of the courts.

5. It is not for the Attorney General to state in the media matters that are currently of the Court's or before Courts. Furthermore it is not for the Attorney General to determine in the media the guilty/innocence, of any accused person. Rather it is a matter for the Courts and the Courts alone to do so when they hand down their after the due process is completed.

6. Proceedings are being prepared for the recovery of tens millions of Kina of public funds that have been paid to the said Law Firm. It is a lengthy process. But when this step has began, an appropriate public announcements will be made.

7. The Attorney General respects the rule of law. In saying that, he recognizes that the only entity vested with the powers to rule on these issues are the Courts of Law. Hence, these matters are for the Courts to determine in the due course.

This Press Statement is clearly in response to the AG sighting the comments reported that Judge Kandakasi undertakes to consult his two brother judges for the Supreme Court to lay formal contempt of court charges against Pala in relation to his initial press release claiming the there was no Supreme Court stay order and secondly suggesting the Paraka bills were legal.

Judge Kandakasi has taken offence to the AG comments because he was one of the Supreme Court Judges that presided over the case and handed down his ruling last Friday finding the Paraka Bills that were subject to that case were in fact illegal.

The Judge since issued a summons for the AG to appear in Court 9:30am this morning to answer contempt of court charges.

In response AG's office quickly issued the above press statement in an effort the judge will reconsider the charges against him or he will rely on it as evidence to prove he regrets his actions.

It's important to note that the wording in the above press statement is written not by the AG but a person in his defence and refers to the AG in third person.

The last time an Minister of Justice was found guilty of contempt of court was in 1979. In that case the Public Prosecutor filed contempt of charges against Mrs. Nahau Rooney former MP for Manus.

On 11th July, 1979, the Minister for Justice the Hon Mrs. Nahau Rooney, wrote on her official (the Minister’s) letterhead a long letter to the Chief Justice of the Supreme Court containing material highly critical of the court and judges; the letter was circulated by the Minister to about forty-five of the most “issue conscious” people in the Nation. It was subsequently published in the Post Courier newspaper on two consecutive days.

The Supreme Court found Ms Rooney guilty of contempt of court and sentence her to 8 months imprisonment. Grand Chief Michael Somare then pardoned her of the charges the next day. 1000 prisoners escaped their cells to protest Somare's decision.
